In a landmark judgement, on Monday today, the Supreme Court has allowed a 26-year-old alleged rape victim to terminate her 24-week pregnancy. The Medical Termination of Pregnancy Act, 1971, prohibits an abortion after 20 weeks of pregnancy as doctors believe abortion may cause life risk. Internationally, a woman can seek an abortion in case of an abnormal foetus. The Supreme Court has directed Mumbai’s KEM hospital to set up a medical board to examine the woman. This was done after the woman had petitioned the court to allow her to abort the foetus. She said the foetus suffers from anencephaly, a serious birth defect in which a baby is born without parts of the brain and skull. Doctors had refused to abort it as her pregnancy surpassed the 20-week legal ceiling.
